Scalia: Gun Carry Limits?

… Watch out for those head axes!

Supreme Court Justice Antonin Scalia appeared on Fox News Sunday where Chris Wallace asked about whether gun control limitations can be legislated using his theories of “textualism”, “originalism” and “purposivism

“We’ll see,” Scalia said, suggesting that future court cases will determine what limitations on modern-day weapons are permissible.

“Some undoubtedly are [permissible] because there were some that were acknowledged at the time” , Scalia said. He cited a practice from that era known as “frighting,” where people “carried around a really horrible weapon just to scare people, like a head axe or something. That was, I believe, a misdemeanor.”

“So yes, there are some limitations that can be imposed,” Scalia said. “What they are will depend on what the society understood were reasonable limitations at the time.”

Shit, and I was getting ready to go out and buy myself a brand new head axe!

    Looks like Scalia has Jumped the Roberts.
    Someone should quietly take him aside and ask him if he interested in what will happen if he rams through some sort of gun ban.

    I suspect he and the others will be very very lucky if they manage to escape to France ahead of the lynch mobs.

    Yes, the states can attempt to regulate firearms. And each time we disagree, they’ll have to be run up through the court system, one case at a time.

    IMO, Scalia is offering a warning of what’s to come. If the GFW’s try often and hard enough, they may come up with something that passes the Constitutional muster of strict constructionists like Scalia, Thomas, and Alito. I find that doubtful, but possible. More likely, these are the type of arguments that Scalia thinks we’ll likely hear from the leftist majority opinion penned by Roberts when the next gun-control legislation is challenged.

    I’ve been a fan of Scalia’s for a long time, and actually had the honor of meeting him briefly (as he took a smoke break from a lecture at the local university). He is as sharp as a tack, and rock-ribbed conservative as they come. I’d be willing to bet my left nut that he’d go to the gallows before pulling a Roberts. That said, he is a man of principle and, as such, would have uphold a distasteful but nevertheless Constitutional law.

    I would wager that most PEOPLE don’t own a firearm — not for ideological or political reasons, but simply because they don’t feel the need — just like most people don’t own or ride motorcycles. It just isn’t something they are interested in.

    It doesn’t mean that “people are out to get your guns,” it just means that they don’t have a vested interest and are more likely to go along with certain limits if convinced they are “needed.”

    I bring up motorcycles as an example because of the helmet laws that most states have enacted. Most of the people who went along with the helmet laws don’t own / never have owned / never will own a motorcycle. But they are so fucking convinced that a helmet law is “needed” because they were convinced of it.

    That said, there are a LOT of progressive democrats who own guns for various reasons — protection, hunting, target, or just because. I don’t want to brag, but I probably own more guns than most people here. Combined. For me, it is a business AND pleasure. I just don’t feel the need to wear it on my sleeve like a lot of people do. I carry on occasion, but it is usually circumstantial. I don’t feel naked without a gun — I am more likely to feel naked without a pen.

    But that is just me. Many of you feel exactly the opposite and that’s alright too. Far be it from me to tell you that you can’t or shouldn’t — at least in public. Private establishments reserve the right to NOT allow you to carry, just as you have the right not to go in. Employers also have the right to not allow weapons on the job. Most of the time it boils down to nothing more that the cost of added liability insurance, not any ideology or political stance. At the end of the day, it is all about money and cost. It is probably the reason why that Colorado theater was a “gun free zone”. The cost of liability insurance to cover the few of you who want to go to the movies strapped is probably cost prohibitive.

    I don’t have a problem (an opinion, yes, but problem, no) with people choosing not to have firearms. Their choice. As a matter of fact, I routinely tell new acquaintances who ask me if they should get one that they need to ask themselves that question instead. If they don’t already know they need one and if they don’t feel sure that they’d actually use it if they had to, then they’re really better off without.

    Of course, I’m more than happy to lecture them until their eyes glaze over on how they really ought to make that decision to own and use one if needed, but that’s just me ;)

    Where I don’t agree is with people who have chosen NOT to own any deciding for ME what “reasonable restrictions” for ME are. Seems to me they’ve already chosen to restrict themselves, so they don’t really get to have a bloody say. That’d be like me not owning a motorcycle stating that everybody else need to be “reasonable” and not own one either.

    My motto is simple: “Mind your own business and keep your hands to yourselves and we’ll get along JUST fine.”
